Terms of use

These terms are the agreement between you and BandSix ("we", "us") when you use bandsix.app. By using the site you agree to them. If you don't agree, please don't use it.

What BandSix is

BandSix is a practice site for the speaking section of the TOEFL iBT® test: Listen and Repeat, and Take an Interview. You record answers, and we score them and give feedback.

BandSix is not affiliated with ETS. TOEFL and TOEFL iBT are registered trademarks of ETS. This product is not endorsed or approved by ETS. Our practice questions are written by us, not taken from ETS or from any test.

Scores are estimates

  • Every score and band BandSix shows is an estimate. Software, including AI models, produces it. It is not an official TOEFL score.
  • ETS scores the real test its own way, and it doesn't publish everything it uses. Your real score can be higher or lower than our estimate.
  • Use our scores to practise and to see what to work on. Don't use them as proof of your English level, or to make admission, visa or job decisions.

Your account

  • You sign in with a link we email you. Keep your email account secure: anyone who can read it can sign in to your BandSix account.
  • An account is for one person. Each account gets one free diagnostic. Please don't create extra accounts to get more.
  • You can delete your account at any time in Settings. See the Privacy policy for what that removes.

Passes and payment

  • A pass gives you full access to the practice sets for 30 or 90 days. It costs US$14.99 (30 days) or US$29.99 (90 days). The price includes any sales tax or VAT; Creem works out the tax for your country.
  • A pass is a one-time payment, not a subscription. Nothing renews, and there's nothing to cancel.
  • Your pass starts when your payment is confirmed. If you buy a pass while another one is still running, the new one starts when the current one ends, so you don't lose any days.
  • Creem is our merchant of record. Creem sells the pass to you, takes the payment, handles sales tax and VAT, and sends your receipt. Creem's terms also apply to the payment: creem.io/terms.
  • Refunds: see our Refund policy. In short, ask within 7 days for a full refund, no questions asked.
  • Scoring uses paid services, so each account has a daily limit on AI-scored answers to stop abuse. With a pass, the limit is far more than a normal day of practice. If the site's AI budget for a day runs out, scoring pauses until the next day (00:00 UTC).

Fair use

Please don't:

  • share your account, or resell access to it;
  • copy our practice questions, guides or feedback in bulk, or use automated tools to collect them;
  • try to break into, overload or get around the limits of the site;
  • record or upload anything that isn't your own practice answer.

We may suspend an account that breaks these rules. If we suspend an account with a running pass for a reason other than misuse, we refund the unused days.

Your content

Your recordings and anything you type stay yours. You let us process them only to run BandSix for you: to score your answers, give feedback and keep your practice history. The Privacy policy explains how.

Our practice questions, guides, feedback text and software belong to us. You may use them for your own practice.

Changes and availability

We keep improving BandSix, so features can change. We try to keep the site running, but we can't promise it will always be available or error-free. If we shut BandSix down while your pass is still running, we will refund the days you haven't used.

If we change these terms, we'll update the date at the top. If a change affects a running pass, it applies only from your next purchase.

Liability

BandSix is provided "as is". As far as the law allows, we are not responsible for indirect losses, such as a test result or a missed deadline. Our total responsibility to you is limited to what you paid us in the last 12 months. Nothing in these terms limits rights you have by law as a consumer.

  • 请把我们的分数用于练习和找出需要提高的地方。不要用它证明你的英语水平，也不要据此做升学、签证或求职决定。

你的账户

  • 你通过我们发到邮箱的链接登录。请保护好你的邮箱：能读你邮件的人就能登录你的 BandSix 账户。
  • 一个账户只供一人使用。每个账户有一次免费诊断。请不要为了多做诊断而注册多个账户。
  • 你可以随时在"设置"中删除账户。删除会清除哪些内容，见隐私政策。

通行证和付款

  • 通行证让你在30天或90天内使用全部练习题。价格为 14.99 美元（30天）或 29.99 美元（90天）。价格已含销售税或增值税，由 Creem 按你所在地计算。
  • 通行证是一次性付款，不是订阅。 不会自动续费，也无需取消。
  • 付款确认后通行证立即生效。如果在一张通行证还有效时再买一张，新的会在当前这张到期后开始，天数一天不少。
  • Creem 是我们的销售方（merchant of record）。 由 Creem 向你出售通行证、收款、处理销售税和增值税，并给你发送收据。付款同时适用 Creem 的条款：creem.io/terms。
  • 退款见退款政策。简单说：7天内申请，全额退款，无需理由。
  • 评分要用到付费服务，所以每个账户每天的 AI 评分次数有上限，以防滥用。有通行证时，这个上限远高于正常一天的练习量。如果全站当天的 AI 预算用完，评分会暂停到第二天（UTC 时间 00:00）。

合理使用

请不要：

  • 共享账户，或转售账户的使用权；
  • 批量复制我们的练习题、指南或反馈，或用自动化工具抓取；
  • 试图入侵网站、让网站超载或绕过使用限制；
  • 录制或上传不是你本人练习回答的内容。

违反这些规则的账户可能会被暂停。如果我们因滥用以外的原因暂停了一个通行证仍有效的账户，我们会退还未使用的天数。

你的内容

你的录音和你输入的内容都归你所有。你只授权我们为你运行 BandSix 而处理它们：给你的回答评分、给出反馈、保存你的练习记录。具体方式见隐私政策。

我们的练习题、指南、反馈文字和软件归我们所有。你可以用于自己的练习。

变更和可用性

我们会不断改进 BandSix，功能可能有变化。我们尽力保持网站正常运行，但不能保证网站始终可用或没有错误。如果在你的通行证仍有效时我们关闭 BandSix，我们会退还你未使用的天数。

如果我们修改本条款，会更新顶部的日期。如果修改影响到正在使用的通行证，只从你下一次购买起生效。

责任

BandSix 按"现状"提供。在法律允许的范围内，我们不对间接损失负责，例如考试成绩或错过的截止日期。我们对你承担的全部责任，以你在过去12个月内付给我们的金额为限。本条款不会限制你作为消费者依法享有的任何权利。
